Terms of Service

1. Who we are

DibbsRadar ("DibbsRadar", "we", "us") is operated by DIBBSRADAR LLC, a Texas limited liability company, at 10730 Potranco Rd, Ste 122 #535, San Antonio, TX 78251. By creating an account or using the service you agree to these terms. If you are using DibbsRadar for a company, you confirm you are authorized to accept these terms for it.

2. What the service is — and is not

DibbsRadar collects publicly available solicitation and award data published by the Defense Logistics Agency through the DLA Internet Bid Board System (DIBBS), together with publicly available federal cataloging data, and presents it in a searchable feed with filters, saved searches, watch lists, email alerts, and a personal bid pipeline.

We are an independent product. We are not affiliated with, endorsed by, or sponsored by the Defense Logistics Agency, the Department of Defense, or any government agency. "DIBBS" and agency names are used only to describe the data source.

DibbsRadar is an information and organization tool. It is not legal advice, procurement advice, bidding advice, or a recommendation to bid on or price any particular solicitation. Any scores, rankings, estimated values, or forecasts in the product are informational estimates produced from historical public data — they are not predictions of any outcome, and you should not treat them as such. Award decisions rest entirely with the government, and pricing and bid decisions rest entirely with you.

3. Data accuracy and coverage

We work hard to keep the data accurate and current, but we want to be straightforward about the limits rather than bury them:

Always verify a solicitation, its terms, its quantities, and its deadlines directly on DIBBS before you quote or bid. You are responsible for your own bids. We are not liable for a bid you did or did not submit, a deadline you missed, or an opportunity you did not see.

4. Accounts

You need an account to use DibbsRadar. You must give accurate information, keep your credentials secure, and tell us promptly at Support@dibbsradar.com if you believe your account has been compromised. You are responsible for activity under your account.

An account is for one customer — a single person or a single company. Sharing one account's credentials across separate businesses, or reselling access, is not permitted (see Acceptable use).

Specifically, we commit that:

We access individual customer data only where necessary to operate the service — for example to fix a bug, respond to your support request, or comply with a valid legal obligation. How we handle personal information generally is described in our Privacy Policy.

You grant us the limited licence needed to host, back up, and display your data back to you so the service can function. That licence ends when you delete the data or your account.

You may use DibbsRadar to research, filter, track, and bid on government solicitations for your own business. You may not:

We may rate-limit, suspend, or terminate accounts that breach this section. The underlying government data is public and you are free to obtain it from DIBBS yourself — what this section protects is our service and the work of assembling it.

8. Availability

We aim to keep DibbsRadar available and its data fresh, and we monitor both. However, we do not offer a service level agreement or an uptime guarantee. The service may be unavailable for maintenance, provider outages, or causes outside our control, and our data refresh depends on systems operated by the government that can change or fail without notice. Interruptions are not grounds for a refund beyond what the Cancellation & Refund Policy provides.

9. Intellectual property

The underlying solicitation, award, and cataloging data originates from US government sources and is not claimed by us. The DibbsRadar service — its software, interface, design, brand, and the specific way we structure, enrich, score, and present that data — belongs to us and is protected by intellectual property law. These terms grant you a limited, non-exclusive, non-transferable right to use the service while your subscription is active, and nothing more.

10. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE DATA IS ACCURATE, COMPLETE, OR CURRENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST CONTRACTS, LOST BIDS, MISSED OPPORTUNITIES, OR LOST OR CORRUPTED DATA, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

11. Termination

You may stop using DibbsRadar and cancel at any time. We may suspend or terminate an account that breaches these terms, that we are legally required to terminate, or whose payment fails and is not resolved. If we terminate your account without cause, we will refund the unused portion of your current billing period.

On termination your right to use the service ends. You may request an export or deletion of your data as described in the Privacy Policy.

12. Changes to these terms

We may update these terms as the product changes. If a change materially affects your rights, we will give notice by email or in the app before it takes effect. Continuing to use DibbsRadar after that means you accept the updated terms. The "last updated" date at the top always reflects the current version.

13. Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Bexar County, Texas, and both parties consent to that jurisdiction.
